The Convention obliges the Member States to arrest and surrender persons sought for the purpose of extradition under simplified procedures provided for by the Convention on the condition that the offences which are punishable under the law both of the requested Party and of the requesting Party. The following information from the requesting State is regarded as adequate:
the identity of the person sought; the authority requesting the arrest; the existence of an arrest warrant or other document having the same legal effect or of an enforceable judgment; nature and legal description of the offence; a description of the circumstances in which the offence was committed; the consequences of the offence in so far as this is possible. Notwithstanding this, the requested State retains the right to request further information if the information provided proves insufficient.
Each Member State must indicate in a statement which authorities are competent to apply the simplified extradition procedure.
The Convention enters into force 120 days after the date of the deposit of the instrument of ratification, acceptance or approval by the last Member State to carry out this formality.
The requesting Party may deliver the extradited person to a third State only if the requested Party agrees or if the extradited person has not, having had an opportunity to do so, left the territory of the requesting Party within a certain period after his final discharge or has returned to that territory after leaving it.
The requested Party shall seize and deliver to the requesting Party property which may be required as evidence or which may have been acquired as a result of the offence.
